What are the general terms and conditions for MUJI passport and MUJI Mile service?

Terms of Use

Article 1 – Purpose 
These terms and conditions is for the services (the “Service”) operated by MUJI (Hong Kong) Company Limited (“Our Company”, “we” or “us”) through our mobile app “MUJI passport (Hong Kong version)” (“MUJI passport”). The user is obliged to comply with the terms and conditions hereinbelow for the use of the Service.


Article 2 - Definition 
The wordings used in these terms and conditions shall be defined as follows:

2.1 “User” shall mean an individual who has downloaded and held MUJI passport.
2.2 “Mile” or “Miles” (“MUJI Mile”) shall mean the reward given by us to User through purchases or participation in certain interactive activities provided in MUJI passport that he/she downloaded or used. Such Miles shall not be exchanged for cash.
2.3 “Point” or “Points” (“MUJI Shopping Point”) shall mean the points converted based on the Miles earned by User. User can use the Points to offset the spending for the purchase at our stores at the rate of 1 Point = HK$1.
2.4 “Valid Period” shall mean the period that the Points remain valid for User to use.
2.5 “User Information” shall mean the information provided by the User for her/her use of the Service or the information acquired through relevant business according to these terms and conditions (including User’s personal data).


Article 3 – Acceptance to the Terms and Conditions 
By downloading or using MUJI passport, User shall be deemed to have accepted to be bound by these terms and conditions. If User does not accept such terms and conditions, User shall remove MUJI passport by following the relevant instruction before use.


Article 4 – Activation or Termination of Service by our Company
4.1 User must download MUJI passport (Hong Kong version) for the use of the Service.
4.2 We reserve the absolute right to terminate User’s right to use this Service without prior notice if we believe that any of the following circumstances has occurred:
  4.2.1 User does any improper act that is harmful to the Service or any other service or system provided by us.
  4.2.2 User has done any improper act that is harmful to the Service or any other service or system provided by us.
  4.2.3 User downloads MUJI passport to a device owned by any other person or by illegitimate means.
  4.2.4 User breaches any of these terms and conditions.
  4.2.5 It is at our absolute discretion that User is considered as unsuitable to use the Service.
4.3 We have no responsibility for any loss or damage incurred by User or any third party arising out of the above circumstances whatsoever.


Article 5 – Immediate Suspension and Cancellation of Entitlements
5.1 We reserve the absolute right to suspend or cancel User’s entitlements without prior notice for any of the following reasons:
  5.1.1 User breaches any items under Sub-Clause 2 of Article 4.
  5.1.2 User uses or induces other person to use the Service in illegal way.
  5.1.3 User makes any unauthorized alteration to any information provided by us without our consent.
  5.1.4 User uses or induces other person to use the Service in illegal way for unlawful purpose.
  5.1.5 User does any improper or fraudulent act.
  5.1.6 It is at our absolute discretion that any act is considered as improper.
5.2 In case of any dispute regarding the Miles or the Service, our decision shall be final and we have the absolute discretion without giving any reason to restrict or suspend User’s rights to use the Service.
5.3

We have no liability to User or no obligation to give any explanation for User's inability to use the Service due to the above reasons.
User shall bear the responsibility for any loss or damage, or expense (including but not limited to legal costs) incurred by the User or any third party arising out of the above circumstances.


Article 6 – Unavoidable Suspension or Termination of Service
6.1 We may suspend or terminate the Service, in whole or in party, without prior notice in the event that any of the following circumstances occurs:
  6.1.1 Regular or urgent maintenance, inspection, repair or update of the system of the Service;
  6.1.2 Any natural disaster or any situation beyond our reasonable control, such as fire, suspension of power supply, earthquake, volcano explosion, flood or tsunami;
  6.1.3 War, unrest, riot or similar situation;
  6.1.4 System having malfunction, or being destroyed, intervened (including any information or source code being invaded), or network or connection problem etc.
  6.1.5 Any other situation that we regard as necessary to suspend or terminate the Service.
6.2 We have no responsibility for any loss or damage incurred by User or any third party arising out of the circumstances as stated in the preceding clause whatsoever.


Article 7 – Security of Personal Data 
User shall keep his/her ID and password etc. safe at the device where User downloads or uses MUJI passport mobile app. In no event shall our Company assume any liability whatsoever if there is any unauthorized use of said device or the Service caused by any of User’s willful or negligent acts.


Article 8 – No Transfer of User Identity
8.1 User shall not lend, transfer or loan his/her identity to any person, corporation or organization. We shall not be liable for any loss or damage incurred by User arising from such situation.
8.2 User shall bear the responsibility for any loss or damage, or expense (including but not limited to legal costs) incurred by User or any third party arising out of the above circumstances.


Article 9 – Personal Data Protection and Privacy Policy
9.1 We are committed to safeguarding the privacy of User in accordance with the Hong Kong Personal Data (Privacy) Ordinance of Hong Kong and our privacy policy, and we ensure that our employees handle personal information in accordance with the strictest standard of security and confidentiality.
9.2 Privacy Policy
  9.2.1 We respect the privacy of all Users. We do not collect excessive personal information from User for the purpose of providing this Service and protect the personal information provided by User in his / her account.
  9.2.2 Unless other specified in these terms and conditions, we do not allow any third party to acquire or handle User Information without User’s authorization.
  9.2.3 We protect and handle User Information in accordance with these terms and conditions. We do not use the User Information for the purpose other than provision of the Service and other related service, and disclose publicly or release such User Information to any third party.
9.3 Purposes of Data Collection
  9.3.1 To verify the User’s identity, establish User’s membership profile, provide the Service and other related service to User by the User Information collected (including but limited to verifying the ID exclusively assigned for the User’s mobile device with using the data of the said mobile device; or providing birthday rewards by collecting the User’ date of birth etc.)
  9.3.2 To tailor our service to the User’s need – we may use the “cookies”, “Javascript” and pixel tags and collect the contents or advertisement the User viewed or User’s spending history.
  9.3.3 To subscribe our service and support – we may collect certain User Information (including contact details) and the record about the services or support that User has requested. Such User Information may also be used to provide updates regarding our products and services as well as similar notices about the services we provide.
  9.3.4 To conduct data analysis – we may use User Information for statistics and analysis in order to develop or improve our services or similar purposes.
  9.3.5 To respond enquires and keep contact – we may respond User for his/her comments or enquiry about our products or related services given by email or left in forum etc. or keep contact with User for providing related information about our Company through email, this Service or other means.
  9.3.6 To market or promote of our products or services or to send member communication, e.g. we may directly communicate User for the latest service update or notice) – we may, therefore, collect the User’s contact information, e.g. name, email address or mobile number.
9.4 We may also use the User Information in case of the following circumstances:
  9.4.1 To report any suspicious cases – If we have proven that there is any act harmful to User or any third party, we may report the relevant information to User or such third party, related organization or authority concerned.
  9.4.2 To investigate complaints – We may use the User Information to investigate and handle any complaint, claim or lawsuit raised by the User against us, other User, our website or our business partners for his/her use of the Service (including but not limited to any verbal or written negotiation).
  9.4.3 Other – If we intend to use the User Information for the service other than those listed above, we shall then post the details on the webpage of the Service.
9.5 Transfer of Personal Information
  9.5.1 The third-party business partners – we may provide User Information to our business partners in providing support service which is necessary for or related to the use of the Service (including but not limited to administration, technical support, customer services, logistics distribution, installation, telecommunication, computer, electronic marketing and other professional services). These business partners shall be contractually required to comply with requisite privacy standards imposed by us.
  9.5.2 Our affiliated companies – we may share User Information with our affiliated companies for the above-mentioned purposes of collection.
  9.5.3 Disclosure by legal requirement – disclosure may be made according to statutory requirement, court order, search warrant or any other enquiry legally required.
  9.5.4 User shall further acknowledge that third party to whom the User Information supplied by User may be transferred in accordance with this sub-clause may be situated outside Hong Kong.
9.6 Marketing and Promotion
  9.6.1 Regarding the above sub-clause 9.3.6, we only use the User Information for marketing purpose under User’s consent (or indication of no objection). User can choose not to receive any unsolicited marketing communication from us. Upon receipt of User’s opt-out request, we shall remove User’s name from our marketing distribution list. However, we shall retain User’s contact information for certain customer service purpose, e.g. notifying User if we fails to provide any of our Service or User’s use of the Service is affected due to whatever reason, or if there is any update regarding the product or service purchased by User or update of other information.
  9.6.2 We do not disclose User’s personal data to any third party without User’s consent for direct marketing purpose.
9.7 User Information will be retained for a period necessary to attain the specified purpose.
9.8 Access or Correction in Personal Data
  9.8.1 User has the right to check whether we hold any of his/her personal data.
  9.8.2 User has the right to request us to correct or update his/her personal data which is incorrect or outdated.
  9.8.3 If User would request to check or update personal data, User can contact us by email or phone. For our contact details, please refer to https://www.muji.com.hk/en/contact-us.php.
9.9 User shall note that under section 19(1) of Personal Data (Privacy) Ordinance, the data access request would be complied within 40 days after receiving such request. If the request is unable or has valid ground to refuse to be complied, in accordance with section 19(2) or 21(2) of the said ordinance, we will give User a notification of such matter within the same 40 days period.
9.10 We may review our Privacy Policy and update this webpage from time to time. Any change, update or revision in this Privacy Policy shall take effective upon posting onto our homepage. Users’ continued use of the Service and MUJI passport shall constitute acceptance of the changes to this Privacy Policy.


Article 10 – Normal Delivery of Notice
10.1 User shall browse the Service to obtain the information publicly disclosed by us or the information related to the Service.
10.2 If any of our notices or promotion messages etc. delays or fails to reach User and such delay or failure is caused by User’ failure to provide us the information requested or to disclose insufficient information, such notices ore messages shall be deemed to have been delivered as normal. We shall not be liable for any loss or damage caused to User therefrom.


Article 11 – Delivery Method of Notice to User
11.1 We may send any notice necessary to User individually or by any other methods that we think fit.
11.2 The delivery of the aforesaid notices to User shall be deemed complete once such notices have been posted in our official homepage.


Article 12 – Offer and Validity of Miles
12.1 On the condition that User has completed any purchase, service or activity recognized by us (e.g. by purchasing our products or checking in at our stores etc.), we shall give certain Miles to User according to the prevailing scheme of the Service. The Service does not give any Miles or allow using any Points for any purchase at any store outside Hong Kong. The Service also does not handle any enquiry for stock availability in any overseas stores.
12.2 Purchase of cash coupons and payment of deposit or any kind of service charges as well as shopping bag charges are not entitled to earn any Miles.
12.3 No Miles will be given for any exchange of product at same price or use of “Goods Exchange Certificate” (GEC). In case User exchanges any product at a higher price, the Miles shall be given based on the surplus amount paid by User.
12.4 All Miles are cleared off at 23:59 on 31 December of each year and start over thereafter. The Points are valid within 30 days from the date when the Points is credited to User’s account.
12.5 We reserve our right to deduce the Miles earned from any purchase of our product or subscription of our service if such product is returned / exchanged or the service subscription is cancelled.


Article 13 – Offer and Use of Points
13.1 We shall from time to time give Points to User with reference to the Miles held by User. The Points can be converted from the accumulated Miles according to the details as published in our official homepage.
13.2 The Points can be used to offset the payment for User’s purchase at our stores. User shall present the mobile devices where MUJI passport has been installed to our staff and express his/her intention to use the Points for payment.
13.3 The Points shall be used at the rate of one (1) Point which represents one (1) Hong Kong Dollar. Any amount less than HK$1 shall be paid by cash, Octopus, credit card, UnionPay or EPS.
13.4 We reserve our right to deduce the Points rewarded from any purchase of our product or subscription of our service if such product is returned / exchanged or the service subscription is cancelled.


Article 14 – No combination of Miles and Points
14.1 The Miles or Points rewarded to User cannot be shared with, presented as gift, loaned, pawned, or transferred to any other Users, or combined with those held by any other Users.
14.2 The Miles or Points held in any account cannot be combined with those held in any other accounts registered with same information.
14.3 The Miles or Points held in an account under any version of MUJI passport other than Hong Kong version shall not used in our stores in Hong Kong or combined with those Miles or Points held in any account under MUJI passport (Hong Kong version).


Article 15 – Invalidation, Deduction or Cancellation of Miles and Points 
In the event that any of the following circumstances occurs, the Miles or Points shall be invalidated, deducted or cancelled, in whole or in part, automatically or by our Company. We have no liability to indemnify or compensate any person for such invalidation, deduction or cancellation of the Miles or Points:

15.1 User fails to use the Points within the valid period.
15.2 User’s right to use the Service is terminated pursuant to Sub-clause 2 of Article 4.
15.3 The information supplied by User contains any untrue, incorrect or unlawful contents.
15.4 User earns the Miles or Points by any inappropriate means.
15.5 User breaches these terms and conditions.
15.6 We at our absolute discretion cancel the Miles or Points given to User.
15.7 The MUJI passport is removed or uninstalled.


Article 16 - Prohibited Acts 
The following acts are prohibited whenever using the Service:

16.1 User uses the Service for any unlawful or profiting-making purposes.
16.2 User does any act that harms or may harm the intellectual property rights (including but not limited to any trademark right, copyright or patent right etc.) or any other rights of our Company, our business partners or any third party.
16.3 User do any act that harms or may harm the property, privacy or any other rights of our Company, our business partners or any third party.
16.4 User do any act that discriminates, defames, libels or damages any reputation or credibility of any party.
16.5 User colludes or may collude in any fraud or any other crimes.
16.6 User transmits, publishes, distributes or discloses any images or messages etc. which is obscene or related to child pornography, child abuse or similar contents.
16.7 User establishes any pyramid scheme or induces any person to join or promote such scheme in improper way.
16.8 User accesses, alters or deletes any contents of our Company or any third party through the Service.
16.9 User pretends or impersonates that he/she is or represents someone else or any other individual or entity to use the Service.
16.10 User transmits any harmful computer program or do any act infringing the privacy of any other individual.
16.11 User uses the Service for any pre-election activity, contest activity or similar activity as well as in breach of any related regulations.
16.12 User delivers any unsolicited electronic message for advertisement, promotion or marketing, or any electronic message which contains or may contain any immoral contents, including but not limited to requesting other to forward a chain letter or acceptance to such request.
16.13 User accesses to any equipment of any third party or any equipment used for providing service operated by us (including but not limited to any communication system, computer system, other devices, or software) with intent to use, prevent or attempt to use or prevent any operation
16.14 User acquires any information related to any third party without his/her consent or by deceptive means.
16.15 User does any act that violates any laws or immoral, any act that intervenes the operation of the Service, any act that causes damage to our reputation or property, or any act harmful to any third party or our Company.
16.16 User encourages any of the above acts (including allowing, encouraging or tolerating any third party to do such kind of acts).


Article 17 – Early Termination
17.1 User may at any time terminate his/her use of the Service. Upon termination of using the Service, all Miles, Points and all rights or entitlements provided or related to the Service shall become invalid. By terminating the use of Service, User shall give up his/her right to claims us for any compensation whatsoever.
17.2 The right to use the Service will be ceased upon the death of User.


Article 18 – Changes of the Service 
Under any of the following circumstances, the Miles or Points in the User’s account shall be invalidated, deducted or cancelled, in whole or partially, automatically or by our Company. We shall have no liability to indemnify or compensate any person such invalidation, deduction or cancellation of Miles or Points:

18.1 User agrees that we may from time to time change, update or revise these terms and conditions, the scheme mechanism and contents of the Service without prior notice. Such change, update or revision shall include without limitation the termination of all or any part of the Service and the contents of MUJI passport, and/or prices of products / services which are stated as “available” in the Service.
18.2 We shall bear no liability to any impact or loss or damage that User suffered or incurred due to such change, update or revision.


Article 19 – Our Proprietary Rights
The contents of the Service and MUJI passport, such as text, graphics, images, music, logos, links, trademarks and other materials (collectively the “Materials”) and compilation hereof are owned by our company or its contents suppliers and protected under relevant laws. User shall not modify, copy, reproduce, sell, post or distribute in any way such Materials or any contents available in the Service, or use such Materials for any public or commercial purpose without our prior written contents.


Article 20 – Disclaimer 
20.1 User uses the Service and MUJI passport at his/her own risk. We shall not be liable for any loss or damage suffered by User arising out of the use of the Service. We shall also have no liability for any loss or damage caused by our deletion of User Information, suspension of User’s right to use the Service or any unavailability, suspension or termination of the Service.
20.2 All features and specification of products described through the Service and MUJI passport are subject to change at any time without notice. The photos and product availability shown there are for User’s reference only. Size, volume or measures are approximate. All prices shown are the regular retail price unless specified otherwise. Product with available stock shown may be sold out in stores. Please contact our stores for product details, prevailing price, the latest offer and product availability.
20.3 We have no obligation to monitor any content posted or made by any users of the Service. If we are of our opinion that any of such contents breaches these terms and conditions or is otherwise objectionable, we may reject, recategorize or delete any such contents without prior notice. User shall bear all risks for the use of such contents.


Article 21 - Breach of Contract 
In the event that User is in breach of Article 16 or any other articles in these terms and conditions, User shall indemnify us or any other party for any loss and damage caused by such breach (including but not limited to legal costs) and hold us and such third party harmless from and against any claims arising from such breach.


Article 22 – Scope, Addition or Change
22.1 If we from time to time publish any requirement in our official homepage or by any other means, or notify User any requirement related to the Service, such requirement shall form part of these terms and conditions. In case of any discrepancy between such individual or additional requirement and the original terms, such individual or additional requirement shall prevail.
22.2 We have the right and absolute discretion to revise these terms and conditions from time to time without User’s consent. Unless otherwise specified by us, the revised terms and conditions shall become effective at the time when such revised terms and conditions are posted onto our official homepage and apply to the Service to be provided thereafter.


Article 23 - Applicable Laws 
These terms and conditions shall be governed and construed by the laws of Hong Kong S.A.R. and any disputes shall be submitted to the non-exclusive jurisdiction of the Hong Kong courts.


Article 24 – Language 
In case of any discrepancy between the Chinese and English versions of these terms and conditions, Chinese version shall prevail.
